Churchwarden Conviction for Pensioner Murder Quashed, Retrial Ordered Background Case Benjamin Field, 35, a former churchwarden was sentenced to prison for the killing of Peter Farquhar. Farquhar is a 69-year-old university lecturer. This case relates to the events that occurred in Maids Moreton in Buckinghamshire, in 2015. After his conviction, a court set the minimum sentence of 36 years. The prosecution claimed that Field used Farquhar to gain financial benefit. He allegedly targeted money as well as property by deception and controlling. Appeal court decision The conviction has now been quashed by senior judges of the Court of Appeal. The Court of Appeal ruled the jurors were not given proper legal advice during their original trial in Oxford Crown Court. They also said that the jury instructions were not correct. The judges also stated that the jury wasn't properly instructed to determine whether Farquhar drank whisky on his own volition. A retrial has been ordered by the court. The judges also permitted the prosecution to continue the case to the Supreme Court by calling this a unique situation. Field will stay in jail while the appeals process is ongoing. The evidence and the legal dispute Prosecutors claimed that Field spiked the whisky during the initial trial to give Farquhar the impression that he wasn't feeling well. He allegedly killed Farquhar when he became too weak to fight back. He also claimed to have staged the death scene in order to make it appear natural. Field's team of lawyers argued that there was no evidence to prove Farquhar had been forced or tricked in taking medication or alcohol. The prosecution's story was questioned. Similar offences and broader allegations Field admitted to fraud and burglary allegations involving Farquhar, and his neighbour Ann Moore Martin (aged 83). Field received 16 years for these offences. This was served along with his conviction of murder. The prosecution said that he created fake relationships with pensioners who were vulnerable.
